In Texas, the surviving spouse, parents, and children - including adult children - of a person who dies due to the negligence of another can file a civil claim of wrongful death. After three months, the personal representative of the estate can file a claim. A wrongful death claim is separate and distinct from any criminal charges that may be filed by the State of Texas in connection with the death.
